1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your access to and use of the Collective Dental Education website and the services, programs, courses, and events we offer (collectively, the "Services"). By accessing our website or registering for any Service, you agree to be bound by these Terms.
Collective Dental Education ("CDE", "we", "us", or "our") is a professional development organisation registered in New South Wales, Australia. These Terms are intended to comply with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and other applicable Australian laws.
If you do not agree to these Terms, please do not use our website or register for our Services.
2. Our Services
CDE provides continuing professional development (CPD) programs, webinars, workshops, courses, and related educational resources for registered dental and oral health professionals in Australia.
Our Services may include:
- Online and in-person CPD courses and workshops
- Webinars and virtual events
- Educational resources and materials
- Certificate programs and structured learning activities
We reserve the right to modify, suspend, or discontinue any Service at any time, with reasonable notice where practicable.
3. Eligibility
Our Services are primarily designed for:
- Registered dental practitioners, including dentists, dental hygienists, dental therapists, and oral health therapists (OHTs)
- Other oral health professionals and students in relevant clinical programs
- Dental educators, researchers, and allied health professionals
By registering, you confirm that the information you provide is accurate and that you meet any eligibility requirements stated for a specific course or event. CDE reserves the right to refuse registration or cancel enrolment where eligibility requirements are not met.
4. Registration and Account
To access most of our Services, you will need to register and create an account. You agree to:
- Provide accurate, complete, and current information at the time of registration
- Maintain the accuracy of your information and update it as necessary
- Keep your login credentials confidential and not share them with others
- Notify us promptly if you become aware of any unauthorised use of your account
You are responsible for all activity that occurs under your account. CDE will not be liable for any loss arising from unauthorised use of your account where you have not taken reasonable steps to protect your credentials.
5. Fees, Payment, and Invoicing
5.1 Fees
Course fees, where applicable, will be clearly stated at the time of registration. All prices are quoted in Australian dollars (AUD) and are inclusive of GST unless otherwise stated. We reserve the right to change our fees at any time; changes will not affect registrations already confirmed and paid.
5.2 Payment
Payment is required at the time of registration unless an alternative arrangement is agreed in writing. We accept payment by the methods listed on our registration pages. Payment processing is handled by secure third-party providers.
5.3 Invoicing
A tax invoice (ABN to be inserted) will be provided upon receipt of payment for all fee-paying events and courses.
6. Cancellations, Transfers, and Refunds
6.1 Cancellation by Participant
If you need to cancel your registration, the following conditions apply:
- More than 14 days before the event: Full refund of any fees paid (excluding any payment processing fees)
- Between 7 and 14 days before the event: 50% refund of fees paid
- Less than 7 days before the event: No refund, unless exceptional circumstances apply
All cancellation requests must be submitted in writing to the CDE contact email address.
6.2 Transfers
You may transfer your registration to another eligible participant at no charge if notice is given at least 7 days before the event. Transfers within 7 days may be subject to an administration fee.
6.3 Cancellation or Postponement by CDE
CDE reserves the right to cancel or postpone a course or event due to insufficient enrolments, presenter unavailability, or other circumstances beyond our control. In the event of cancellation by CDE:
- You will receive a full refund of fees paid, or the option to transfer to another event
- CDE will not be liable for any additional costs you may incur (e.g. travel or accommodation)
6.4 Australian Consumer Law — Consumer Guarantees
Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law, including consumer guarantees that cannot be excluded by contract. If our Services are not provided with due care and skill, or are not fit for purpose, you may be entitled to a remedy under the Australian Consumer Law.
7. Intellectual Property
All content created and provided by CDE, including course materials, presentations, videos, handouts, assessment tools, website content, and branding (the "CDE Content"), is owned by or licensed to Collective Dental Education and is protected by copyright and other intellectual property laws.
By registering for a course or event, you are granted a limited, non-exclusive, non-transferable licence to use CDE Content for your personal professional development purposes only. You must not:
- Copy, reproduce, distribute, or transmit CDE Content to third parties without our prior written consent
- Use CDE Content for commercial purposes
- Modify, adapt, or create derivative works from CDE Content
- Remove or alter any copyright or proprietary notices
Any third-party content included in our programs is used with permission and remains the intellectual property of the respective owners.
8. Participant Conduct
By participating in our Services, you agree to:
- Engage respectfully and professionally with CDE staff, presenters, and other participants
- Not record, photograph, or livestream any event without express written permission from CDE
- Not engage in conduct that is disruptive, discriminatory, harassing, or otherwise inappropriate
- Comply with any specific conduct requirements outlined for individual courses or events
CDE reserves the right to remove any participant from an event, or restrict access to our Services, where their conduct does not meet these standards. No refund will be provided where removal is due to participant misconduct.
9. CPD Compliance and Professional Responsibility
CDE provides CPD programs to assist dental professionals in meeting their continuing education obligations under AHPRA and the Dental Board of Australia. Responsibility for tracking, recording, and meeting CPD requirements rests with the individual practitioner.
CDE will provide CPD certificates of attendance or completion where applicable. We make no representation that completion of our courses will satisfy all regulatory or employer CPD requirements in all circumstances.
Course content is provided for educational purposes and does not constitute clinical advice. Practitioners are responsible for applying their own professional judgement in clinical practice.
10. Limitation of Liability
To the extent permitted by law, CDE's total liability to you for any claim arising from or in connection with these Terms or our Services (whether in contract, tort, negligence, or otherwise) is limited to the amount of fees paid by you for the relevant Service.
To the extent permitted by law, CDE excludes all liability for:
- Indirect, consequential, special, or incidental loss or damage
- Loss of data, profits, revenue, or anticipated savings
- Loss of professional opportunity or reputation
This limitation does not apply to liability arising from death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be limited or excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you may have under the Australian Consumer Law.
11. Disclaimer
Our website and course materials are provided in good faith and on an "as is" basis. While we take reasonable care to ensure the accuracy and currency of information provided, CDE does not warrant that:
- Our website will be free from errors or available at all times
- Course content will meet your specific professional needs or circumstances
- Information provided is current at the time of your access
We recommend that you independently verify any clinical, regulatory, or professional information before relying on it in practice.
12. Privacy
The collection, use, and handling of your personal information is governed by our Privacy Policy, which forms part of these Terms. A copy of our Privacy Policy is available on our website. By using our Services, you agree to the terms of the Privacy Policy.
13. Links to Third-Party Websites
Our website may contain links to external websites for your convenience. CDE does not control, endorse, or take responsibility for the content, practices, or privacy policies of third-party websites. We encourage you to review the terms and privacy policies of any third-party websites you visit.
14. Amendments to These Terms
CDE may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised effective date. Your continued use of our Services after the updated Terms are posted constitutes your acceptance of the changes.
For registrations made prior to any change in Terms, the Terms in effect at the time of registration will apply to that registration.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales.
If a dispute arises in connection with these Terms or our Services, the parties agree to first attempt resolution through good faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may seek resolution through mediation or the courts.
Nothing in this clause prevents either party from seeking urgent injunctive relief from a court.
16. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision will be severed from these Terms and will not affect the validity and enforceability of the remaining provisions.
17. Entire Agreement
These Terms, together with our Privacy Policy and any registration confirmation or specific course conditions provided to you in writing, constitute the entire agreement between you and CDE in relation to your use of our Services and supersede all prior arrangements, representations, or understandings.
